Terms of Use

1. Acceptance of Terms

By accessing or using Vancomyzer™ or any services provided by Dōsys Health LLC (“Company,” “we,” “us”) through the website dosys.health or any associated applications (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Service.

2. Eligibility

Vancomyzer™ is intended for use by licensed healthcare professionals only, including but not limited to pharmacists, physicians, nurse practitioners, and physician assistants. By using the Service, you represent that you are a licensed healthcare professional or are using the Service under the supervision of one.

3. Description of Service

Vancomyzer™ is a clinical decision support tool that provides AUC-guided vancomycin dosing recommendations based on the Colin 2019 two-compartment population pharmacokinetic model. Regulatory status depends on the software function, intended use, and jurisdiction; this description does not establish an exemption from medical-device requirements. 4. Account Registration

Certain features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity under your account.

5. Subscription & Payment

Existing subscriptions and institutional agreements retain their agreed terms. Manage an existing subscription in Billing, or contact us about your agreement.

Existing institutional agreements retain their written scope. Team administration, audit logs, multi-site arrangements and any business associate agreement require separate written review. EHR integration is not included.

Cancel online through Vancomyzer Settings → Billing → Manage billing / cancel. Administrators of existing institutional subscriptions use Team → Manage billing. Cancel before the trial ends to avoid a charge, or before renewal to stop the next charge. Cancellation takes effect at the end of the current paid period. No refunds are provided for partial billing periods unless required by applicable law.

Subscription confirmation emails include renewal and cancellation details. Renewal reminders include management links. Pricing changes require applicable notice and consent; where California law applies, notice of an accepted fee change is sent at least seven and no more than 30 days before it takes effect. A new public price does not automatically change an existing agreement, and continued free use does not authorize a charge.

6. Acceptable Use

Subject to these Terms and payment of any applicable fees, Dōsys grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for internal clinical, educational, and quality-improvement purposes, as an individual professional or under an institutional subscription. Use in the course of your practice or employment, including at a for-profit institution, is permitted.

You agree not to:

  • Use the Service for any purpose other than clinical decision support as intended.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service.
  • Transmit any Protected Health Information (PHI) through unsecured channels or in violation of HIPAA.
  • Share account credentials with unauthorized individuals.
  • Resell, rent, sublicense, white-label, or otherwise make the Service available to anyone who is not an authorized user under your own subscription.
  • Operate the Service as a service bureau or application service provider, or offer dosing services to third parties as a standalone product built on it.
  • Access the Service in order to design or develop a competing product.
  • Use the Service in any manner that violates applicable law or regulation.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and the Vancomyzer™ name and mark — are the exclusive property of Dōsys Health LLC and are protected by U.S. and international copyright, trademark, and intellectual property laws.

8. Limitation of Liability

To the fullest extent permitted by law, Dōsys Health LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Service. Our total aggregate liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim. See our Medical Disclaimer for clinical-specific liability limitations.

9. Indemnification

You agree to indemnify and hold harmless Dōsys Health LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Data export will be available for 30 days following termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hidalgo County, Texas.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
