1. Acceptance of Terms
By accessing or using Vancomyzer™ or any services provided by Dosys Health LLC (“Company,” “we,” “us”) through the website dosys.health or any associated applications (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Service.
2. Eligibility
Vancomyzer™ is intended for use by licensed healthcare professionals only, including but not limited to pharmacists, physicians, nurse practitioners, and physician assistants. By using the Service, you represent that you are a licensed healthcare professional or are using the Service under the supervision of one.
3. Description of Service
Vancomyzer™ is a clinical decision support tool that provides AUC-guided vancomycin dosing recommendations based on the Colin 2019 two-compartment population pharmacokinetic model. The Service is classified as non-device clinical decision support software under the 21st Century Cures Act, Section 3060. For complete clinical disclaimers, see our Medical Disclaimer.
4. Account Registration
Certain features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity under your account.
5. Subscription & Payment
Vancomyzer™ offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually as selected at the time of purchase. All fees are stated in U.S. dollars.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods unless required by applicable law.
We reserve the right to modify pricing with 30 days' written notice. Continued use after the effective date of a price change constitutes acceptance of the new pricing.
6. Acceptable Use
You agree not to:
- Use the Service for any purpose other than clinical decision support as intended.
- Attempt to reverse-engineer, decompile, or extract the source code of the Service.
- Transmit any Protected Health Information (PHI) through unsecured channels or in violation of HIPAA.
- Share account credentials with unauthorized individuals.
- Use the Service in any manner that violates applicable law or regulation.
7. Intellectual Property
All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and the Vancomyzer™ name and mark — are the exclusive property of Dosys Health LLC and are protected by U.S. and international copyright, trademark, and intellectual property laws.
8. Limitation of Liability
To the fullest extent permitted by law, Dosys Health LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Service. Our total aggregate liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim. See our Medical Disclaimer for clinical-specific liability limitations.
9. Indemnification
You agree to indemnify and hold harmless Dosys Health LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Data export will be available for 30 days following termination.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hidalgo County, Texas.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
